FOUR AT 11"
((I DON'T WANT ANY FAMILY TO
EVER GO THROUGH WHAT MY
FAMILY HAS GONE THROUGH))
THE FAMILY OF A NURSING HOME
PATIENT WHO DIED AFTER A VIOLENT
ATTACK WANTS CHANGE FROM COUNTY
LAWMAKERS.
GOOD EVENING.
THAT CHANGE IS MOVING FORWARD --
AS FAMILIES ASK FOR HELP.
"RUTHIE'S LAW" WOULD HOLD
NURSING HOMES MORE ACCOUNTABLE.
NEWS 4'S CALLAN GRAY WAS AT A
PUBLIC HEARING TONIGHT ON THE
PROPOSED
LAW...CALLAN?
IT WAS A SMALL BUT POWERFUL
PUBLIC HEARING.
A FEW FAMILIES TEARFULLY
EXPLAINED THE HORRIBLE
CONDITIONS THEIR
LOVED ONES ENDURED AT WESTERN
NEW YORK NURSING HOMES.
THEY SUPPORT RUTHIE'S LAW..
BUT GROUPS REPRESENTING ELDERLY
CARE FACILITIES SAY IT
WOULD BE UN-ENFORCEABLE.
IN AUGUST 2016 RUTH MURRAY
WANDERED INTO THE ROOM OF A MAN
WITH DEMENTIA--
HER FAMILY TELLS US SHE WAS
BEATEN..AND THE FACILITY
DOWNPLAYED WHAT HAPPENED.
SHE DIED LESS THAN TWO DAYS
LATER.
((IT WAS JUST HORRIFIC, THE LIES
IT WAS JUST HORRIBLE
WHAT THEY TOLD ME HAPPENED AND
WHAT I WALKED IN ON ))
THE STATE FINED EMERALD SOUTH.
BUT RUTH'S DAUGHTER CAROL
KUSZNIAJ IS PUSHING FOR RUTHIE'S
LAW TO PREVENT THIS
FROM HAPPENING TO ANOTHER
FAMILY.
THE LAW WOULD HOLD NURSING HOMES
ACCOUNTABLE -- BY REQUIRING THEM
TO
NOTIFY FAMILY MEMBERS WITHIN TWO
HOURS OF AN INJURY..REQUIRE
REPORTS OF INJURIES TO THE
COUNTY COMMISSIONER OF SENIOR
SERVICES ,
MAKE QUALITY REVIEWS MORE
AVAILABLE, AND ALLOW THE
COMMISSIONER TO
SUBPOENA FOR INFORMATION.
AT A PUBLIC HEARING-- OTHER
FAMILIES SHARED THEIR OWN
STORIES OF WAITING
FOR ANSWERS AT OTHER LOCAL
FACILITIES.
((DON'T WAIT TO GET YOUR STORY
STRATIGHT THAT'S
EXACTLY WHAT'S HAPPENING AT
THESE NURSING HOMES, THEY'RE
TRYING TO GET THEIR STORY
STRAIGHT, ARE YOU
KIDDING ME))
((I DO NOT WANT TO MAKE THEM
SOUND LIKE THEY ARE
MONSTERS BUT THE ADMINISTRATORS
DO NOT CARE, THEY DO NOT CARE))
((NOBODY EVER WANTS TO SEE
ANYTHING BAD LIKE HTAT
HAPPEN TO A NURSING HOME PATIENT
OR ANYBODY))
BUT RANDY GERLACH-- DISTRICT
PRESIDENT FOR THE NEW YORK STATE
HEALTH
FACILITIES ASSOCIATION-- SAYS
THIS LAW WOULD BE UNENFORCEABLE
BECAUSE THERE ARE ALREADY STATE
AND FEDERAL REGULATIONS.
(( THERE'S NOT A NEED TO
DUPLICATE THOSE))
((WE HEARD INFORMATION ABOUT
OTHER LAWS THAT MAY
BE APPLICABLE BUT CLEARLY
THEY'RE NOT ALL WORKING OR WE
WOULDN'T HAVE HAD THE
EXPERIENCES WE HEARD ABOUT
TODAY SO I INTEND TO VOTE FOR
IT))
COUNTY LEGISLATOR PETER SAVAGE
WAS THE ONLY LEGISLATOR AT
TONIGHT'S PUBLIC
HEARING.
HE IS ONE OF THE SPONSORS OF THE
LAW..
IT IS CURRENTLY IN THE HEALTH
SERVICES COMMITTEE WHICH MEETS
ON THURSDAY--
THEY WILL DECIDE WHETHER TO MOVE
IT FORWARD TO THE FULL
